Prince Edward Island records and privacy laws

Prince Edward Island extended its access and privacy law to municipalities in 2019, has its own health information law that also reaches the private sector, and controls the disposal of government records through its Archives and Records Act.

Freedom of Information and Protection of Privacy Act (FOIPP)

Governs access to records and the protection of personal information held by public bodies. Amendments extended it to Island municipalities; for the City of Charlottetown, this came into effect April 1, 2019 and applies to records from that date forward.

Who it affects: provincial public bodies and Island municipalities.

Health Information Act

In effect since July 1, 2017. Applies to all persons and organizations that collect, use or disclose personal health information, including Health PEI and the private sector, and requires mandatory reporting and disclosure of privacy breaches.

Who it affects: Health PEI, health care providers and private health organizations.

Archives and Records Act

Government records must be retained and disposed of according to retention and disposition schedules approved by the province's committee, and destroying or altering a public record to deprive a public body of it is an offence.

Who it affects: provincial departments and designated agencies.

Personal Information Protection and Electronic Documents Act (PIPEDA)

This is the federal private-sector privacy law. Prince Edward Island does not have its own general private-sector privacy law, so PIPEDA applies to personal information that businesses collect, use or disclose in commercial activity.

Who it affects: Island businesses.

How The Auxilium Group supports these requirements. The Auxilium Group keeps records in Canada, controls access by role, keeps a history of who created and changed each record, and can hold records for the retention periods you set. Meeting a law is still your organization's responsibility. Tell us which rules apply to you and we will show you how The Auxilium Group would handle them, or tell you plainly where it would not.

This is general information about Prince Edward Island law, not legal advice. Check the current law and your own obligations with your legal or privacy advisor.
